Terms of Service
Effective Date: Feb 2026
These Terms of Service (“Terms”) govern access to and use of the Northing mobile application (the “App”) operated by Northing Technical Limited (Company No. 16953712), registered at Collingwood Buildings, 38 Collingwood Street, Newcastle, NE1 1JF, United Kingdom (“Company”, “we”, “us”, “our”).
By creating an account or using the App, you agree to these Terms.
01. Eligibility
The App is rated 4+ on the Apple App Store. By using the App, you confirm you are legally capable of entering into a binding agreement under applicable law.
The App is intended for use within the United Kingdom.
02. Nature of the Service
Northing is a factual, systematic ledger for UK summit logging.
The App:
- Provides structured summit registry data
- Processes user-uploaded activity files (including GPS and FIT formats)
- Integrates with Strava to import activity data
- Records and displays personal summit completion history
The App does not:
- Provide routes
- Provide navigation
- Provide difficulty ratings
- Provide safety classifications
- Recommend “best” ways to complete summits
- Provide weather guarantees
- Provide terrain guarantees
All decisions relating to outdoor activity remain entirely the user’s responsibility.
03. Account Registration
Access requires Sign in with Apple.
You agree to:
- Provide accurate account information
- Maintain control of your Apple ID credentials
- Notify us of unauthorised access
Accounts may be deleted within the App. Upon deletion, personal data will be handled in accordance with the Privacy Policy.
04. Subscriptions and Payment
Northing offers:
- Registry – Free tier
- Archive – £24.99 per year (7-day free trial)
Payments are processed exclusively through Apple In-App Purchase.
Subscription terms:
- Payment is charged to your Apple ID account at confirmation of purchase
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Renewal charges occur within 24 hours prior to the end of the current period
- Subscriptions may be managed and cancelled through your Apple account settings
We do not process payments directly and cannot issue refunds. Refund requests must be directed to Apple.
05. User Data and Activity Files
Users may upload GPS or FIT files and connect a Strava account.
You retain ownership of your activity data. By uploading or syncing data, you grant us a limited licence to process, analyse, and display that data solely for the operation of the App.
You are responsible for ensuring you have the right to upload any files.
We may retain operational, audit, security, and compliance logs as reasonably necessary to maintain system integrity.
06. Assumption of Risk
Outdoor and mountain activities involve inherent risks, including but not limited to:
- Injury
- Severe weather
- Terrain hazards
- Navigation error
- Equipment failure
- Illness or death
The App provides records only. It does not assess safety.
You acknowledge and agree:
- You assume full responsibility for all outdoor decisions
- You independently assess conditions, terrain, and personal capability
- You rely on your own judgement at all times
Use of the App does not reduce or transfer risk.
07. No Warranty
The App is provided “as is” and “as available”.
We make no warranties regarding:
- Accuracy of summit data
- Accuracy of GPS processing
- Accuracy of elevation calculations
- Availability of the App
- Compatibility with third-party services
- Continuous Strava integration
Data discrepancies may occur.
08. Limitation of Liability
To the fullest extent permitted by law:
- We exclude all liability for indirect, incidental, consequential, or special damages
- We are not liable for personal injury or death arising from use of the App
- We are not liable for loss of data, revenue, reputation, or opportunity
Nothing in these Terms excludes liability where exclusion is unlawful under UK law, including liability for death or personal injury caused by negligence or fraud.
Total aggregate liability shall not exceed the amount paid by you for the subscription in the 12 months preceding the claim.
09. Third-Party Services
The App integrates with Strava. We are not responsible for Strava service interruptions, data accuracy, changes to APIs, or any third-party platform functionality.
Use of third-party services is governed by their own terms.
10. Termination
We may suspend or terminate access if you breach these Terms, misuse the App, or if continued operation becomes unlawful.
You may terminate at any time by deleting your account and cancelling any active subscription through Apple.
11. Intellectual Property
All summit registry structures, system logic, design elements, and App content (excluding user data) are the intellectual property of Northing Technical Limited.
You may not copy, reproduce, reverse engineer, or distribute any part of the App without written permission.
12. Governing Law
These Terms are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
